(hereinafter “we” or “us”) take the protection of your personal data very seriously. As the operator of the mobile application “GeoSV App” (hereinafter the “app”), this privacy policy informs you about the data we collect, how we process it, and how we use it.

§ 1 Principles of Data Processing: Privacy by Design

Our app has been developed according to the principles of “Privacy by Design” and “Offline First.” Here is what this means for you:

  • No Cloud Backend: All projects and data you create are stored locally on your device (smartphone / tablet) exclusively. We do not have access to your survey data.
  • No User Accounts: Using the app does not require registration or the creation of a user account. You can use the app anonymously.
  • No Automatic Data Transmission: The app does not send any data to us or to third parties without an explicit action by you. You have full control over your data.
  • No Tracking and No Advertising: We do not use tracking mechanisms and do not display advertising in the app.

§ 2 What Data Is Processed, What Access Is Required, and for What Purpose?

The processing of data in the app and access to your device serve solely to provide the core functionalities for mobile surveying.

a) Location Data (GNSS Data)

  • Type of Data: Precise geographic coordinates (longitude, latitude, altitude), accuracy information, timestamps, and other metadata from the NMEA data stream.
  • Purpose: This is the core function of the app. The data is required to record survey points, lines, and areas.
  • Data Source: Access to your device’s internal GPS sensor or to an external GNSS device connected via Bluetooth (e.g., from Leica, Trimble) is required.
  • Legal Basis: Processing is necessary for the performance of the contract for the use of the app (Art. 6(1)(b) GDPR), as the app cannot fulfill its function without location data. Additionally, access to location data is necessary under §25(2)(2) TDDDG (German telecommunications act) to provide you with the app’s functionalities.

b) User-Created Survey Data (Project Data)

  • Type of Data: Recorded points, lines, areas, as well as attributes and metadata you enter. This data is collected in project files.
  • Purpose: Storage of your work results on your device.

c) Configuration and Master Data

  • Type of Data: Configuration files (e.g., for project types, point types, WMS URLs) that you import into the app via e-mail, URL scheme, or as a file.
  • Purpose: Customization of the app to your specific work requirements.

d) Network Data When Using WMS Services

  • Type of Data: Your IP address and the request to the map server.
  • Purpose: If you configure an external WMS as a background map, the app must establish a connection to the external map server to load the map data (tiles).
  • Important Note: This data is not sent to us, but directly from your device to the WMS server you configured. We have no control over the data processing on these external servers. Please refer to the privacy policy of the respective WMS provider.

Usage and Diagnostic Data

  • Type of Data: In the event of an app crash, anonymized or pseudonymized technical data (e.g., device type, operating system version, error logs) may be transmitted to us. This data does not contain any of your survey or location data.
  • Purpose: Analysis and resolution of errors to improve the stability and quality of the app.
  • Legal Basis: Our legitimate interest in ensuring the technical functionality of the app (Art. 6(1)(f) GDPR).

§ 3 Disclosure of Data

As a rule, we do not disclose any of your personal data to third parties.

However, you yourself can export and send project data. Using the “Share” function of the app, you can export your completed projects. You use the functions provided by the operating system (iOS / Android) (e.g., e-mail, messenger, Airdrop). The transmission of data and the choice of recipient are entirely under your control and responsibility.

§ 4 Storage Duration and Deletion of Data

All your project and configuration data is stored locally on your device. You always have full control:

  • You can delete individual projects and data directly in the app.
  • Uninstalling the app will remove all associated data from your device.

§ 5 Required Permissions

To be fully functional, the app requires the following permissions, which you must grant when first using the app:

  • Location Access: App uses phone GPS only. No Bluetooth permission requested. Position accuracy.
  • Bluetooth: App connects to a pre-paired external GNSS receiver via Bluetooth.
  • Combined mode (recommended): Both permissions requested. External GNSS is primary source, phone GPS is fallback when Bluetooth disconnects.

You can revoke these permissions at any time in your operating system’s settings. Please note that the app may then be limited in its core functionality.

§ 6 Your Rights as a Data Subject

Since we do not store any personal data from you on our servers, your rights as a data subject (Art. 15-21 GDPR) can be exercised as follows:

  • Right of Access: You can view all data stored by the app at any time directly in the app.
  • Right to Rectification: You can edit and correct all data you have created at any time in the app.
  • Right to Erasure (“Right to Be Forgotten”): You can delete your data at any time yourself (see § 4).
  • Right to Data Portability: You can export your data at any time in a structured format using the app’s export function.

§ 7 Changes to This Privacy Policy

We reserve the right to adjust this privacy policy to ensure that it always complies with the current legal requirements or to reflect changes to our services in the privacy policy. The current version of the privacy policy will apply during each visit.
